1. Agreement

By using Wapify ("the Service"), you agree to these Terms of Service. The Service is provided by Digital Sales Ascension FZCO, registered in Dubai Silicon Oasis, United Arab Emirates (License 61926). If you do not agree to these terms, do not use the Service.

2. Service Description

Wapify provides AI-powered lead qualification for WhatsApp and Instagram. The Service includes:

  • WhatsApp integration via QR code connection.
  • AI-powered conversation analysis and lead scoring.
  • Real-time notifications for qualified leads.
  • CRM dashboard with pipeline management.
  • Conversation history and analytics.

3. Subscription and Payment

Wapify is offered at $497 per month. All prices are in USD. Subscriptions are billed monthly and renew automatically. You may cancel at any time. Cancellation takes effect at the end of your current billing period. No refunds are issued for partial months.

4. Money-Back Guarantee

We offer a 30-day money-back guarantee: if you do not receive at least 10 qualified leads within your first 30 days of active use, we will refund your first month's payment in full. To qualify:

  • Your WhatsApp must be connected and active for the full 30-day period.
  • You must have received inbound messages during this period.
  • You must contact us within 7 days of the 30-day mark to claim the guarantee.

5. Acceptable Use

You agree not to:

  • Use the Service for spam, unsolicited messaging, or any activity that violates WhatsApp's Terms of Service.
  • Attempt to reverse-engineer, decompile, or extract the AI models or algorithms.
  • Share your account credentials with unauthorized users.
  • Use the Service for any illegal activity.
  • Transmit malware, viruses, or harmful code through the Service.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You retain ownership of your data. By connecting your WhatsApp, you grant us permission to process messages through our AI for the purpose of lead qualification.

7. Intellectual Property

The Service, including its AI models, algorithms, design, and code, is the intellectual property of Digital Sales Ascension FZCO. Your subscription grants you a non-exclusive, non-transferable license to use the Service for your business.

8. Limitation of Liability

To the maximum extent permitted by law:

  • Our total liability is limited to the amount you paid for the Service in the 3 months preceding the claim.
  • We are not liable for indirect, incidental, or consequential damages.
  • We are not liable for any losses resulting from AI-generated responses or lead scoring accuracy.
  • We do not guarantee any specific business results, revenue, or conversion rates.

9. Service Availability

We aim for 99.9% uptime but do not guarantee uninterrupted service. We are not liable for downtime caused by third-party services (WhatsApp, cloud providers), scheduled maintenance (with 24-hour notice), or force majeure events.

10. Termination

We may suspend or terminate your account if you violate these terms, engage in abusive behavior, or fail to pay. Upon termination, your access to the Service ceases immediately. Your data will be retained for 30 days, after which it may be permanently deleted.

11. Governing Law

These terms are governed by the laws of the United Arab Emirates. Any disputes will be resolved through arbitration in Dubai under the rules of the Dubai International Arbitration Centre (DIAC). You waive any right to participate in class action proceedings.

12. Changes

We may update these terms from time to time. Material changes will be communicated via email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
